Thousands of farmers in the Greater Noida area could soon receive relief after the Uttar Pradesh government cleared the way for eligible farmers to claim 64.7% additional compensation linked to land acquired or purchased between 2002 and 2013.
The decision is expected to benefit around 4,500 farmers, according to the Greater Noida Authority. The estimated financial liability for providing the additional compensation is more than ₹500 crore.
However, the compensation will not be released automatically to every farmer covered by the period. The Greater Noida Authority will first verify land, farmer and compensation records and identify those who meet the prescribed eligibility conditions.
Government Clears Way for Additional Compensation
The issue relates to farmers who did not receive the 64.7% additional compensation despite their land being acquired or purchased during the relevant period.
Some farmers were reportedly unable to approach the court for financial or other reasons. With the latest government order, such cases can now be reconsidered under the applicable rules.
The Greater Noida Authority had approached the Uttar Pradesh government seeking permission to extend the benefit to eligible farmers who had missed out on the additional compensation. Following the proposal, Alok Kumar, Additional Chief Secretary, Uttar Pradesh government, permitted the authority to take further action according to the prescribed rules.
This means the authority can now begin the process of examining these cases and determining which farmers qualify for the benefit.
Around 4,500 Farmers Could Benefit
According to the Greater Noida Authority, approximately 4,500 farmers could benefit from the decision.
The estimated cost of providing the additional compensation to eligible farmers is over ₹500 crore. Since the financial liability is substantial, the authority will need to carefully examine the available records before releasing any payment.
The process will include verification of documents related to land acquisition or purchase, details of the farmers concerned, compensation already paid and other relevant records.
After completing the verification, the authority will prepare a list of farmers found eligible under the applicable rules. The payment process can then move forward.
Who Can Get the 64.7% Additional Compensation?
The benefit is linked to farmers whose land was acquired or purchased between 2002 and 2013 and who have not received the applicable 64.7% additional compensation.
However, merely falling within this period will not automatically make a farmer eligible. The Greater Noida Authority will determine eligibility after examining the relevant land and compensation records.
The government order has opened the way for reconsideration of cases where farmers had not received the additional benefit for various reasons, including cases where they could not approach the court.
Compensation Linked to Original Amount
For eligible farmers, the additional compensation will be calculated at 64.7% of the original compensation amount determined for their land.
For example, if a farmer's original compensation was fixed at a particular amount, the applicable rules will be used to calculate an additional 64.7% on that original compensation.
The authority will first verify the original compensation, payments already made and other relevant documents before determining the amount payable.
Decision Linked to Allahabad High Court Case
The Greater Noida Authority's proposal referred to the Allahabad High Court's Gajraj and Others vs. State of Uttar Pradesh and Others case.
The authority sought permission to provide the 64.7% additional compensation to farmers who had not received the benefit earlier, subject to the applicable rules.
Following the state government's approval, the authority can now proceed with the necessary examination and further action.
Farmers Await Eligibility Verification and Payment
The government order has brought fresh hope to thousands of farmers who have been waiting for the additional compensation. Around 4,500 farmers are expected to potentially benefit, with the overall financial liability estimated at more than ₹500 crore.
